Are ebay photos copyrighted or protected by the original owner?
I'm selling many things on ebay and all of my pictures have a famous celebrity holding her personal items that she's selling. For each item it states that she's willing to personally sign the item to the winning bidder. My question is do newspapers have the right to take those photos and publish them in their newspapers? Because that is what is happening and I believe since I took the photos I should have the rights to them. As they never got permission to use them, can I do anything about it?
There is a fair use doctrine in copyright law. I basically states that in certain situations that people can use copyrighted materials. In this case a journalist would state that they were allowed to use the images under the FUD because they were needed for a newspaper article.
